Consumer Credit File Rights Under State and Federal Law (CROA)

Federal law provides you with important rights regarding your credit information. Before choosing to work with any credit repair organization, you should understand these rights.


Your Rights Under Federal Law

You have the right to dispute inaccurate information contained in your credit report by contacting the consumer reporting agency (credit bureau) directly.

Neither you nor a credit repair organization has the right to remove accurate, current, and verifiable information from your credit report.

Only information that is inaccurate, incomplete, unverifiable, or otherwise not reportable under applicable law may be corrected or removed following an investigation by the credit reporting agencies or information furnishers.


Negative Information Generally Remains on Your Credit Report

Most negative information may legally remain on your credit report for up to seven (7) years.

Certain information, including Chapter 7 bankruptcy filings, may remain for up to ten (10) years.


You Have the Right to Obtain Your Credit Report

You have the right to obtain a copy of your credit report from each nationwide consumer reporting agency.

You may qualify to receive a free credit report under certain circumstances, including:

• You have been denied credit, employment, insurance, or housing based on information contained in your credit report within the previous 60 days.

• You are unemployed and intend to apply for employment within the next 60 days.

• You receive public assistance.

• You believe your credit file contains inaccurate information due to fraud or identity theft.

Consumers are also entitled to receive free annual credit reports as permitted by federal law.


You Have the Right to Dispute Information

If you believe information in your credit report is inaccurate, incomplete, or unverifiable, you have the right to submit a dispute directly to the consumer reporting agency at no cost.

After receiving your dispute, the consumer reporting agency is generally required to investigate the information and notify you of the results within the time allowed by law.

If inaccurate or unverifiable information cannot be verified, it must be corrected or removed in accordance with applicable law.


You May Add a Consumer Statement

If a dispute is not resolved to your satisfaction, you have the right to submit a brief written statement explaining your position.

The credit reporting agency may include this statement with future credit reports issued in your name.


You Have the Right to Cancel

If you enter into a contract with a credit repair organization, federal law provides you with the right to cancel the contract without penalty or obligation before midnight of the third (3rd) business day after signing the agreement.

You should receive a written Notice of Right to Cancel explaining how to exercise this right.


Credit Repair Organizations Cannot

Federal law prohibits credit repair organizations from:

• Making false or misleading representations regarding their services.

• Advising consumers to provide false information to any creditor or consumer reporting agency.

• Charging or receiving payment for services before those services have been fully performed, except where otherwise permitted under applicable law.

• Misrepresenting the services they provide or the results consumers may expect.


You May File a Complaint

If you believe a credit repair organization has violated your rights under federal law, you may file a complaint with the appropriate government agencies.

You may also have the right to bring a legal action against a credit repair organization that violates the Credit Repair Organizations Act or other applicable consumer protection laws.
